terms

Terms of use, sales and copyright.

The fine print, written plainly. These terms are governed by New Zealand law and never limit your rights under NZ consumer law.

About these terms

This website is run by Arteries Limited ("Arteries", "we", "us"), the creative studio of Glenn McLeary and Claire Delaney McLeary, based in Aotearoa New Zealand.

By using this website or buying from our shop you agree to these terms. We may update them from time to time; the version on this page at the time of your order applies.

Your consumer rights

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Our goods come with guarantees that they are of acceptable quality, fit for purpose, match their description and are delivered within a reasonable time.

If something you buy has a fault, is damaged in transit or isn't as described, contact us and we'll repair, replace or refund it as the law requires.

If you are buying for business purposes, the Consumer Guarantees Act does not apply, to the extent allowed by section 43 of that Act, and the Fair Trading Act provisions are excluded to the extent allowed by section 5D of that Act.

Orders, prices and payment

All prices are in New Zealand dollars and include GST. Payment is taken securely by Stripe at checkout; we never see or store your card details.

An order is accepted once payment is confirmed. If an item turns out to be unavailable or incorrectly priced, we'll let you know and offer a full refund.

Many of our works are handmade or one-off, so small natural variations in colour, grain and finish are part of their character and are not faults.

Delivery

We currently ship within New Zealand only. Delivery times are estimates. Please check your order when it arrives and tell us about any damage within 7 days so we can put it right.

Change-of-mind returns

We're happy to accept change-of-mind returns on unused items in original condition within 14 days of delivery. Return postage is at your cost. This is in addition to, not instead of, your rights under the Consumer Guarantees Act.

Original artworks, commissioned work and digital downloads can't be returned for change of mind, but your statutory rights still apply if they are faulty or not as described.

Digital downloads

When you buy a digital product, such as a PDF book, you receive a personal, non-transferable licence to download and read it on your own devices.

You may not share, resell, upload, publicly host, print for distribution or otherwise copy the file. Download links are personal to your order and expire after a short time.

What you can and can't do with our work

You can view and enjoy the site, share links to our pages, and share images from our official social accounts using the platform's own share tools, with credit to the artist.

You can't without our written permission: copy, reproduce, print, download, alter, sell or distribute our work; use it on products, merchandise, in advertising or for any commercial purpose; or claim it as your own.

No AI use. You may not use any content from this website to train, fine-tune or prompt artificial intelligence or machine-learning systems, or to create derivative or "in the style of" works by those means. Automated scraping of images or text is not permitted.

Want to license an image, reproduce a piece or collaborate? We'd love to hear from you; just get in touch.

Moral rights

Glenn and Claire assert their moral rights under Part 4 of the Copyright Act 1994, including the right to be identified as the authors of their work and the right to object to derogatory treatment of it.

Commissions and design work

Commissioned art, design and consulting projects are covered by a separate written agreement or quote. Unless that agreement says otherwise, we keep the copyright in concepts and artwork, and the client receives a licence to use the final work for the agreed purpose once paid in full.

The Escape Artist and retreats

Bookings for The Escape Artist and our retreats and workshops will have their own booking terms, provided when you book.

Website use and liability

We take care to keep this site accurate and running, but we can't promise it will always be error-free or available. Links to other websites are provided for convenience and we aren't responsible for their content.

To the extent permitted by law, we aren't liable for indirect or consequential loss from using this website. This doesn't affect your rights under the Consumer Guarantees Act or Fair Trading Act.

Your information

We only collect the personal information needed to fulfil your order or reply to your enquiry, and we handle it in line with the Privacy Act 2020. You can ask to see or correct the information we hold about you at any time.

Governing law and contact

These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
